Nebraska

Caswell, Plager & Westerhold, LLC

LINCOLN, Neb. — The maximum weekly income benefit under the Nebraska Workers' Compensation Act will increase to $1,166.00 for work-related injuries and illnesses occurring on or after January 1, 2026. The minimum weekly income benefit will remain $49.00.

The maximum rate is equal to 100 percent of the state average weekly wage, rounded up to the next whole dollar, as determined by the Nebraska Workers' Compensation Court. This rate is established according to the statutory formula outlined in NEB. REV. STAT. §§ 48-121.01 and 48-121.02.

The previous maximum and minimum benefit levels will continue to apply for injuries and illnesses occurring within their respective effective periods. A chart detailing maximum and minimum weekly benefit rates over time is available on the court’s website.
